Terms of Service

These Terms of Service (“Terms”) govern your access to and use of themobiletee.com (the “Site”) and any products or services offered by The Mobile Tee (“we,” “us,” “our”), including equipment rentals (mobile golf simulators, LED mini golf) and related delivery, setup, and support (collectively, the “Services”). By using the Site or booking our Services, you agree to these Terms.
If you do not agree, do not use the Site or Services.
1) Who We Are
The Mobile Tee provides mobile golf entertainment, including golf simulator rentals and LED mini golf setups for events. Contact details appear in Section 18.
2) Eligibility
You must be (a) at least 18 years old, and (b) legally able to enter contracts. If booking on behalf of a company, you represent you are authorized to bind that company.
3) Quotes, Bookings & Payment
Quotes. Quotes are estimates and valid for [30] days unless stated otherwise. Availability is not guaranteed until payment is made.
Deposits. A Deposit may be required to secure your date. Deposits apply to the final balance.
Taxes & Fees. Prices exclude applicable taxes, surcharges, and delivery or mileage fees unless stated otherwise.
4) Customer Responsibilities
You agree to:
Ensure all permits, venue approvals, and permissions are obtained.
Keep the area clean, dry, and free of hazards; supervise children and guests at all times.
Follow all instructions and safety rules provided by our staff or documentation.
Prevent food/drink spills and misuse of equipment; no smoking near equipment.
5) Safety, Assumption of Risk & Health
Participation involves physical activity and inherent risks (e.g., swinging clubs, tripping hazards). By participating, you and your guests assume all risks associated with use. If you or any participant has a medical condition that could be affected by participation, consult a physician and refrain if advised.
We may halt or refuse Services if conditions are unsafe or instructions are not followed.
6) Weather, Rescheduling, Cancellations & Refunds
Weather. For safety, we may pause, reschedule, or cancel due to high winds, lightning, heavy rain, or other unsafe conditions.
No-Show / Access Issues. If we cannot access the site or start on time due to your venue or guests, wait-time fees or partial/no refunds may apply.
Force Majeure. Neither party is liable for delays/failures due to causes beyond reasonable control (e.g., severe weather, acts of God, strikes, utility outages). Payments may be credited or rescheduled per our then-current policy.
7) Prohibited Uses
No illegal, unsafe, or abusive use of equipment; no modification or relocation after setup; no use by visibly intoxicated individuals; no metal spikes or objects that could damage surfaces or equipment.
8) Communications; SMS Terms
By providing contact information, you agree we may contact you regarding your order and support. If you opt in to SMS, you consent to receive text messages related to orders, scheduling, delivery/pickup, support, and—if separately opted in—promotions.

9) Photos & Recordings
We may take non-identifying photos/videos of our setups for documentation and safety. With your permission, we may use event photos/videos for marketing. Tell our staff or email us if you prefer not to be photographed.
10) Site Use, IP & Content
The Site and its content (text, images, logos, software) are owned by us or our licensors and protected by IP laws. You may not copy, modify, reverse engineer, or use content except as permitted by these Terms or with our written consent.
You are responsible for content you submit (e.g., reviews). You grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, and display such content for Site operation and promotion. Don’t submit unlawful, infringing, or harmful content.
11) Third-Party Services
We may integrate third-party tools (e.g., payment processors, analytics, messaging platforms). Those providers’ terms and privacy policies apply to their services. We are not responsible for third-party websites or services.
12) Disclaimers
EXCEPT AS EXPRESSLY STATED, THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation, or specific outcomes.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (AND OUR OWNERS, EMPLOYEES, AND CONTRACTORS) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE/GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SITE OR SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted.
14) Indemnification
You agree to defend, indemnify, and hold harmless The Mobile Tee and our owners, employees, and contractors from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your (a) misuse of the Site/Services, (b) breach of these Terms, (c) negligence or willful misconduct, or (d) event-site conditions you control.
15) Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the state or federal courts located in [Stark County], Ohio for any dispute not subject to small-claims court. Each party waives objections to venue and personal jurisdiction in those courts.

17) Changes to These Terms
We may update these Terms from time to time. The Effective Date will reflect the latest version. Material changes will be posted on this page. Continued use after changes constitutes acceptance.
18) Miscellaneous
Severability. If any provision is found invalid, the remainder remains in effect.
No Waiver. Failure to enforce a provision is not a waiver.
- Contract/Rental Agreement. You may be required to sign a rental agreement or contract based on your event with terms that may combine with or change these terms of service as per contract/agreement.
Assignment. You may not assign your rights without our consent; we may assign as part of a merger or asset transfer.
Entire Agreement. These Terms (plus any signed order/quote/rental agreements and our Privacy Policy) are the entire agreement regarding the Services.
